이 논문의 연구목적은 남북합의서의 이행에 있어 제기되는 법적·현실적 한계를 분석하고 이를 해결하기 위한 대안을 모색하는데 있다. 이 논문은 2010년 5월 24일 남북관계를 전면 중단시킨5.24조치의 법적 성격과 그 파급효과를 분석하고 이에 상응한 법적 장치로서 「남북관계발전에관한법률」 제23조의 활용 가능성과 한계를 분석한다. 남북은 현재까지 총 643회의 남북회담을 통해 239건에 달하는 남북합의서를 체결한 바 있다. 남북관계는 남북협상의 결과물이라 할 수 있는 남북합의서 이행에 의해 진전되어 왔다. 그러나 2010년 5월 24일 `천안함 사태 관련 대북조치 발표문`(이후 5·24 조치)이 공표된 이후 남북관계는 중단되었고 남북합의서의 효력 또한 사실상 정지되었다. 5.24 조치는 결과적으로 기존에 체결된 남북간 합의를 전면적으로 무력화시키는 결과를 가져왔다. 이와 관련하여 2005년 제정된 「남북관계발전에관한법률」 제23조는 남북합의서의 `정지`에 관한 절차규정을 두고 있다. 이 논문은 5.24조치와 같이 남북관계를 전면적으로 중단시키는 조치가 남북관계, 특히 남북합의서의 효력을 무력화시키는 현실을 어떻게 안정적으로 관리할 것인가에 관하여 분석하고 대안을 모색하고자 한다.
This study purports to analyze the legal and practical limits hampering the implementation of the inter-Korean agreements, and figure out alternatives to cope with the limits. We have raised the possibility to utilize the article 23 of Development of Inter-Korean Relations Act as an exit of the Measures Against North korea on May 24th-so called the May 24th Measures-which halts the exchanges between two Koreas. Two Koreas have concluded 239 agreements with 643 inter-Korean dialogues. Ties between two Koreas have made progress by implementing the inter-Korean agreements. However, the relations between two Koreas has been in stalemate after the announcement of the May 24th Measures, and the inter-Korean agreements also drifted. We pinpoint that if the ROK Government enforce crucial measures such as the May 24th Measures to suspend the inter-Korean relations and relevant inter-Korean agreements, it should be in compliance with the article 23 of Development of Inter-Korean Relations Act. According to the article, it is required for the ROK Government to earn approval from the National Assembly to cease the inter-Korean agreements which was approved by the Assembly, and also reviewed by the Cabinet council to standstill the inter-Korean agreements which was deliberated by the Cabinet council.
